Rajya Sabha: Prosecution of armed forces under AFSPA

A document submitted by India’s Ministry of Defence in Parliament has again confirmed that the Armed Forces (Special Powers) Act enables impunity for human rights violations in Jammu and Kashmir.

On 1 January, the Ministry, in response to a question raised by Rajya Sabha MP Husain Dalwai, said that it had received 50 requests from the Jammu and Kashmir government seeking permission, or ‘sanction’, to prosecute armed forces personnel suspected of committing human rights violations.

The number of cases in which sanction was granted: zero.

In 47 cases, sanction to prosecute was denied. In three cases – one of them dating back to 2006 – sanction is ‘pending’.
